Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Nebula Interactive, LLC, a Wyoming limited liability company operating Foretiva ("we," "us," "our"), and govern your use of foretiva.com (the "Service"). By using the Service you agree to these Terms. Questions: support@nebulainteractivellc.com.
1. What Foretiva is (and isn't)
Foretiva is a free prediction game for private events such as weddings, graduations, and baby showers. An organizer creates an event and its yes/no questions, guests join by invite link and make their calls, and the sharpest predictions win a prize the organizer provides. Foretiva is not gambling. No money is ever wagered, pooled, or collected from players, no entry fee is ever charged to play, and predictions have no monetary value. We provide the game software only; events are created and run entirely by their organizers.
2. Eligibility
You must be at least 13 years old to use the Service. To organize an event you must be at least 18, or be acting with the supervision and consent of a parent or other responsible adult who agrees to these Terms.
3. Accounts
Using the Service requires signing in with your Google account; we never see or store your Google password. You are responsible for activity under your account and for keeping access to your Google account secure. Notify us promptly at support@nebulainteractivellc.com if you suspect unauthorized use.
4. Free for players; organizers pay a flat fee
Playing is free, always. Organizers pay a one-time fee of $2.99 to schedule an event. That's it: no subscriptions and no recurring charges. We may issue promo codes that waive the fee for selected events, at our discretion. We may offer optional paid conveniences to organizers in the future (for example extended history retention); any fee is shown clearly before purchase and processed by Stripe; we never see or store card details. No paid feature will ever involve collecting money from players or wagering of any kind.
5. Prizes
Prizes are offered, funded, and delivered solely by event organizers. Foretiva never holds, transfers, or guarantees any prize, and is not responsible for prize fulfillment. Organizers may play in their own events but can never win their own prize. If a promised prize is not delivered, that is a matter between the players and the organizer.
6. Your content
Event names, descriptions, questions, and nicknames you submit remain yours. You grant us a license to host and display them to the people you share your event with, which is what the Service exists to do. You agree not to submit content that is unlawful, harassing, hateful, profane, or sexually explicit, that infringes anyone's rights, or that includes payment handles, wallet addresses, or requests for money. Payment references in user content are also blocked automatically at the database level.
Profanity and explicit material are not permitted anywhere on the Service, including event names, descriptions, questions, prizes, and nicknames. If an event contains such material we may cancel the event and ban the organizer, and any fees the organizer has paid will not be refunded.
7. Prohibited conduct
- Using the Service to run, disguise, or facilitate wagering or any game played for money.
- Collecting or soliciting money from players in connection with an event.
- Harassing other players or submitting offensive content, including profanity or explicit material.
- Attempting to alter predictions after the lock, or otherwise defeat game integrity.
- Accessing the Service by automated means or interfering with its operation.
8. Game integrity
Predictions lock 24 hours before the event start, for everyone, with no exceptions. The event date cannot be changed after publishing. These rules are enforced by the system itself, and answers to questions are decided by the organizer at resolution, subject to the dispute window shown on the event page. The organizer's resolutions are final.
9. Enforcement
We may remove content, cancel events, or suspend accounts that violate these Terms, harm other users, or expose us to legal risk, with or without notice. When an event is cancelled or an organizer is banned for a violation, any fees already paid are not refunded. Report problems to support@nebulainteractivellc.com.
10. Intellectual property
The Service, including its software, design, and branding, is owned by Nebula Interactive, LLC or its licensors. These Terms grant you no rights in it beyond normal use of the Service.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any event will take place as described by its organizer.
12. Limitation of liability
To the fullest extent permitted by law, Nebula Interactive, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss related to prizes, events, or user content. Our total liability for any claim relating to the Service will not exceed fifty dollars (US $50).
13. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, your events, or your violation of these Terms.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access as described in Section 9. Sections that by their nature should survive termination do survive it.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be signposted on the site. Continuing to use the Service after changes take effect means you accept the revised Terms.
16. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules.
